Welcome to Lokul. Please read these Terms and Conditions ("Terms," "Agreement") carefully before downloading, installing, or using the Lokul mobile application and our website located at https://www.lokul.live (collectively, the "Service"). This Agreement constitutes a legally binding contract between you ("User," "you," or "your") and Lokul ("Company," "we," "us," or "our"). By creating an account, accessing, or using the Service, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are strictly prohibited from using the Service and must delete the application immediately.

1. Eligibility and Age Restrictions

The Service is intended solely for mature audiences. You must be at least 18 years of age to create an account or use the Service. By accessing or using Lokul, you represent and warrant that

  • You are at least 18 years old and possess the legal capacity to enter into a binding contract.
  • You will provide accurate, current, and complete information during registration.
  • You have not been previously suspended or removed from our Service.

2. Account Registration and Security

To utilize Lokul, you must register for an account using our supported authentication methods.

  • You are entirely responsible for maintaining the confidentiality of your session credentials and for all activities that occur under your account.
  • You agree to notify us immediately at support@lokul.live if you suspect any unauthorized access or breach of security.
  • Lokul will not be liable for any losses or damages caused by unauthorized use of your account.

3. App Store and Device Specific Terms

If you download the Service from the Apple App Store, the following additional terms apply

  • Acknowledgment: You acknowledge that these Terms are between you and Lokul only, not Apple, and Lokul is solely responsible for the Service.
  • Maintenance and Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
  • Warranty: In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
  • Product Claims and IP: Lokul, not Apple, is responsible for addressing any claims relating to the Service, including product liability, legal compliance, and intellectual property infringement claims.

4. User-Generated Content and License

A. Your Responsibility

Lokul allows users and hosts to submit, post, link, and share content, including event listings, messages, comments, and profile elements ("User Content"). You retain ownership of your User Content, but you are solely responsible for its legality and reliability.

License Grant to Lokul

By posting User Content, you grant Lokul a worldwide, non-exclusive, royalty-free, perpetual, transferable, and sublicensable license to use, modify, publicly display, reproduce, distribute, and host that content to operate and promote the Service.

Content Moderation

Lokul reserves the right to monitor, review, flag, filter, modify, or remove User Content at our sole discretion using human and automated screening technologies. Additionally, Lokul provides in-app tools to block abusive users and report objectionable content.

5. Digital Millennium Copyright Act (DMCA) Policy

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied or posted on the Service in a way that constitutes copyright infringement, please provide our designated Copyright Agent with the following information at legal@lokul.live

  • A description of the copyrighted work that you claim has been infringed.
  • A description of where the infringing material is located on the Service.
  • Your contact information (address, telephone number, and email).
  • A statement that you have a good faith belief that the disputed use is not authorized.
  • A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

6. Prohibited Conduct and Public Safety Disclaimers

A. Unpermitted Assemblies and Street Takeovers

Lokul is designed exclusively to facilitate lawful, peaceful, and permitted community gatherings. We strictly prohibit the use of our platform to coordinate, market, encourage, advertise, or spectate unpermitted assemblies, illegal gatherings, or activities that disrupt public safety.

  • In strict compliance with state and local laws—including but not limited to Florida Statutes § 316.191 —the use of Lokul to organize, facilitate, promote, or participate in illegal street takeovers, drag racing, stunt driving exhibitions, unpermitted intersection closures, or street blockades is explicitly prohibited.
  • Any event listing, group chat, or user account found to be coordinating or promoting a street takeover or any assembly that threatens public infrastructure will be permanently terminated immediately and without warning .
  • Lokul reserves the right to preserve all relevant data and cooperate fully with law enforcement authorities regarding public endangerment.

General Restrictions

You agree not to use the Service to

  • Post content that is defamatory, violent, obscene, hateful, or discriminatory.
  • Harass, abuse, stalk, or threaten other users.
  • Scrape, data mine, or frame our mapping and event feeds without express written consent.

7. Platform Role and Event Liability Disclaimer

A. Passive Venue Only

Lokul acts purely as a passive, neutral platform. Lokul is not an event organizer, broker, creator, host, or employer. We do not vet, guarantee, or sponsor the safety, legality, or execution of any event posted on the platform.

Assumption of Risk

  • Attending Events: Your attendance at any event discovered via Lokul is entirely voluntary and at your own risk. You assume all risks, known and unknown, including property damage, bodily injury, or illness. You waive and release Lokul and its affiliates from any claims arising out of interactions at real-world venues.
  • Hosting Events: If you host an event, you represent that you possess all necessary local permits, insurance, and authorizations. You assume full legal liability for your events and agree to indemnify Lokul against third-party claims.

8. Paid Features, Subscriptions, and Boosted Listings

A. Auto-Renewing Subscriptions and Purchases

Lokul may offer premium paid tiers and advertising utilities (like "boosting"). All financial transactions, billing cycles, and payment collections are managed and executed exclusively by our secure third-party payment processors (e.g., Apple App Store). If you purchase a recurring subscription, it will automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions through your Apple ID Account Settings.

Fees and No Refunds

All fees paid to Lokul are non-refundable , except as explicitly required by law or the external platform's policies.

External Ticketing Links

Any ticketing costs visible on standard event cards are strictly informational. Transactions via external links occur entirely outside of Lokul. Lokul is not the merchant of record for third-party events.

9. Host Analytics Disclosure

If you interact with an event (updating your status to "Going" or checking in), the event host will have access to localized attendance analytics. By RSVPing or checking in, you explicitly authorize the transmission of your platform profile name, attendance status, and precise timestamp of your check-in to that event host's dashboard.

10. Account Termination

We reserve the right to suspend or permanently terminate your account and block your access to the Service at any time, with or without notice, for any reason. You may voluntarily delete your account directly through the in-app settings menu.

11. Limitation of Liability and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LOKUL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO THE SERVICE, THE CONDUCT OF ANY THIRD PARTY, OR YOUR PHYSICAL ATTENDANCE AT ANY EVENT DISCOVERED THROUGH THE SERVICE.

12. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

Informal Dispute Resolution

Before filing a formal claim, you agree to try to resolve the dispute informally by contacting legal@lokul.live within thirty (30) days.

Agreement to Arbitrate

You and Lokul agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be settled by binding, individual arbitration rather than in a court of law.

Class Action and Jury Trial Waiver

YOU AND LOKUL AGREE THAT ANY PROCEEDINGS WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR LOKUL WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

Arbitration Rules and Location

The arbitration will be administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration will take place exclusively in the State of Florida.

30-Day Opt-Out Right

You have the right to opt out of this binding arbitration clause and class action waiver within thirty (30) days of first creating an account. To opt out, send written notice to legal@lokul.live with the subject "Arbitration Opt-Out."

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States . Except for disputes subject to arbitration, any legal suit shall be instituted exclusively in the state or federal courts located in Florida.
